Chapter 1 General Provisions

Article 1 (Object)
The purpose of this Agreement is to stipulate matters in the use of all services, procedures and other necessary matters provided by the website (http://www.bswellnesstour.com) operated by Busan Wellness Life (hereinafter “Company”).

Article 2 (Definition of Terms)
The following terms have the meanings specified below:
① Member: An individual who has provided basic personal information and has been granted an ID by signing a service use contract with the Company
② ID: A combination of letters and numbers selected by the user and assigned by the site for the purpose of identifying users and using services
③Password: A combination of letters and numbers selected by the user to confirm the identity of the user and to protect his/her personal information in communication
④ Termination: The act of a member terminating the contract of use by the member or Company

Article 3 (Disclosure, Effect and Change of Terms and Conditions)
① The Terms and Conditions are presented on the membership registration page and  the Busan Wellness Life may change the terms and conditions if there are important business matters. The changed terms and conditions will be announced through Notice.
② These Terms and Conditions and the terms and conditions to be changed according to some circumstances of the Company will take effect upon disclosure to the users.

Article 4 (Rules not Specified in the Terms and Conditions)
If matters not specified in the Terms and Conditions are laid down in the Telecommunications Framework Act, the Telecommunications Business Act, the Information and Communication Promotion Act, the Act on Consumer Protection in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, Digital Signature Act, Act on Promotion of Information and Communications Network Utilization, etc., Consumer Protection Act and other related laws and regulations, they must follow the related laws and regulations.

Chapter 2 Service Use Contract

Article 5 (Application for Use)
① The user can apply for use by agreeing to the Terms and Conditions and personal information protection policy in the membership registration guide, processing the registration procedure (filling out the registration application form of the Company) and clicking the 'confirm' button.
② An applicant must use their real name and actual information. One date of birth can apply for one application for use.
③ A member who do not enter his/her real name or actual information cannot be protected by law and may be restricted from using the service.

Article 6 (Acceptance of Application for Use)
① Busan Wellness Life accepts the use of this service to the applicants pursuant to Article 5, with the exception of paragraphs 2 and 3.
② Busan Wellness Life may withhold acceptance until the reason for the restriction is resolved in the following cases.
A. When facility related to services is not available.
B. When there is a technical constraints.
C. When deemed necessary for Busan Wellness Life
③ Busan Wellness Life may withdraw or decline consent in the following cases:
A. At the time of application for use in other person's name 
B. In case of falsely describing the information of the applicant
C. When there is a concern that it may impede the well-being of society or sound moral
D. In case the application requirements set by the company are insufficient

Chapter 3 Obligations of the Contracting Parties

Article 7 (Obligations of Busan Wellness Life)
① Busan Wellness Life has an obligation to operate the website stably and continuously.
② Busan Wellness Life shall promptly deal with opinions or complaints raised by users if they are recognized as justifiable. However, if it is difficult to process them immediately, the reason and processing schedule must be notified to the user through a notice or e-mail.
③ If a request or a warrant from a related agency or the Korea Information and Communication Ethics Committee is presented for the purpose of investigation, or there is a matter in accordance with laws and regulations, the Paragraph ① shall not apply.

Article 8 (Obligations of Members)
① Members must understand and comply with these terms and conditions, company notices, site information, etc., and shall not engage in any acts that interfere with the Company's business.
② Members may not engage in any commercial activities using the service without prior consent of this site.
③ Members cannot copy, reproduce, change, translate, publish, broadcast, or otherwise use the information obtained through the use of this site's services or provide it to others without the prior consent of the site.

Chapter 4 Provision and Use of Services

Article 9 (Service Use)
① Users use the website in compliance with the provisions of the Terms and Conditions.
② Matters not specified in these terms and conditions regarding the use of services shall be determined by the Company and posted as a notice or separately announced.

Article 10 (Provision of Information)
Busan Wellness Life can provide the member with a variety of information deemed necessary during the use of the service by e-mail or correspondence.

Article 11 (Advertising)
① Busan Wellness Life may post advertisements, etc. on the service page, website, e-mail, etc. in relation to the operation of the service.
② Busan Wellness Life is not responsible for any loss or damage that occurs as a result of a member's participation in, communication, or transaction of advertisers posted on the site.

Article 12 (Restriction on Service Use)
If a user shall engage in any of the following acts in connection with the use of the service, Busan Wellness Life may restrict the user.
① Acts that harm good customs and other social order
② Acts that aim to have the purpose of crime acts or are objectively recognized to be related to criminal acts
③ Acts that damage the reputation of others or significantly impair the use of services of others
④ Acts that continuously transmit certain contents such as advertising information against the will of others
⑤ In case the sound operation of the service is hindered by hacking or spreading computer viruses
⑥ Acts that infringe on the intellectual property rights of others or if it's judged that the intellectual property right holder can claim infringement of the intellectual property right
⑦ Misuse of another member's password and ID
⑧ Acts that violate relevant laws and regulations or in case that the Company determines that the user is inappropriate

Article 13 (Suspension of Service)
Busan Wellness Life may suspend all or some services in the following cases.
① In case the service is suspended by the key telecommunication service provider or internet network operator as stipulated in the Telecommunications Business Act
② If the service cannot be provided due to a power outage
③ In case of unavoidable circumstances due to facility relocation, repair or construction
④ When it is difficult to provide normal service due to service facility failure or excessive use of the service
⑤ In case of war, disaster, natural disaster, or a national emergency equivalent thereto occurs or is likely to occur

Article 14 (Management of Posted Material)
For the establishment of a health communication culture and efficient website operation, the Company may delete, move, or refuse registration of a post at discretion when it is judged that the posted or provided data by the user falls under Article 12.

Article 15 (Responsibility for Service Use)
Users cannot engage in business activities, in particular, hacking, money-making advertisements, commercial activities through obscene sites, and illegal provision of commercial S/W, to sell illegal products using the service unless specifically permitted in an express written document signed by an authorized employee of the Company. The company is not responsible for the results, losses and legal actions such as arrest by the relevant authorities of the business activities caused by violating this Article.

Chapter 5 (Order and Payment of Goods)Article 16 (Reservation and Payment Method)Members can only pay through wire transfer for the goods offered and sold by the Busan Wellness Life not through various payment methods such as prepaid cards, debit cards, and credit cards. For the user’s payment method, Busan Wellness Life does not collect additional fees other than goods.① Busan Wellness Life notifies reservation confirmation to a user when there is a reservation request from the user. Reservation details will be displayed on the relevant webpage.② The user who received the verification notice for the reservation may request to change or cancel the reservation immediately after receiving the notice for any discrepancy in intention, etc. If there is a user's request before the confirmation of the reservation, Busan Wellness Life will process it without delay. However, if the payment has already been made, the Article 17 (Cancellation and Refund Policy) shall apply.

Article 17 (Cancellation and Refund Policy)
When the goods reserved or purchased by the user cannot be delivered or provided due to out of stock, etc., Busan Wellness Life notifies the user of the reason without delay. If payment for goods, etc. has been made in advance, the Company issues a refund or takes necessary measures within 14 business days from the date of receipt of the payment.
① If the user cancels the reservation before the reservation is confirmed, Busan Wellness Life shall cancel the reservation. Due to the nature of the product, cancellation is not possible 3 days (42 hours) or less prior to the effective date of the reserved product.
② If the goods have been dispatched or the refundable period (14 days) has passed after receiving the reservation confirmation notice of the goods, the payment cannot be canceled. However, in the case of damage or deterioration of goods due to negligence or force majeure of Busan Wellness Life, the Company shall refund or exchange the purchase amount to the user.

Chapter 6 Other Matters

Article 18 (Indemnification and Compensation for Damages)
① If the service cannot be provided due to a natural disaster or force majeure equivalent thereto, the Company's responsibility for providing the service is exempted.
② The Company shall not bear any responsibility for the results arising from the mutual transaction between users or between users and third parties.
③ The Company does not bear any responsibility for the accuracy, reliability, etc. of facts with respect to the information, data, content, etc. posted by a user on the bulletin board, and the user must use this site at his/her own risk.
④ The user is responsible for any damage that occurs in relation to the data posted or transmitted by the user, or any disadvantage in relation to the selection of the data or other disadvantages related to the use of the service provided free of charge.
⑤ The user is responsible for the management of his/her ID and password, any damage caused by the user's negligence, or illegal use of login information by a third party.
⑥ In the event that damage occurs to the Company due to a user's violation of the provisions of the Terms and Conditions, the user shall compensate the Company for all damages and indemnify the company from the damage.

Article 19 (Consent to Provision and Use of Personal Credit Information)
The personal credit information acquired by the Company in connection with membership registration shall be provided to and used by others in accordance with Article 23 of the Act on the Use and Protection of Credit Information by obtaining the consent of the user. User consent means that a user agreed to use his/her personal credit information as data to judge the user's credit by credit information agencies, credit information providers, and other users or as policy data by public institutions.

Article 20 (Settlement of Disputes)
① The Company and the users shall make all necessary efforts to amicably resolve disputes related to the use of this website.
② Notwithstanding the provisions of Paragraph 1, if a lawsuit is filed due to the dispute, the lawsuit shall be deemed to be under the jurisdiction of the court having jurisdiction over the location of the Company's headquarters.

These Terms come into force on November 1, 2021.

3. Retention and Usage Period of Personal Information

Busan Wellness Life obtains consent from users to provide advertising information in accordance with related laws such as the Personal Information Protection Act, etc. and regularly check the consent from the user to receive advertising information. If the user does not agree, there may be restrictions on benefits depending on the purpose of use, such as product/service introduction and solicitation, and events. There are no other disadvantages related to financial transactions.

[Advertising Contents]
The advertising information such as perks and benefits, event, wellness and new product information provided by the Busan Wellness Life is sent to the users in accordance with the relevant laws and regulations. However, informational content that is obligatory to be provided other than advertising information shall be provided regardless of consent to the reception.

[Retention]
Members may withdraw the consent at their will even after consent to the reception of marketing information. Even if they do not consent to reception, they can use the basic services provided by the Busan Wellness Life without receiving marketing information.

[Change of consent]
You can withdraw your consent (agree/withdraw) by deactivating the checkbox in the marketing consent box in My Page.
